Trinamool Congress MP Raises Legal Concerns Over Waqf Bill

NEW DELHI: In a pressing matter concerning the Waqf (Amendment) Bill, 2024, Trinamool Congress Lok Sabha MP Kalyan Banerjee has reached out to Lok Sabha Speaker Om Birla, urging his intervention to address significant legal issues regarding the draft report of the Joint Parliamentary Committee (JPC).

Suspensions and Dissent Notes Under Scrutiny

In his letters, dated February 3, Banerjee highlighted two primary concerns: the suspension of JPC members by the committee chairman and the removal of dissent notes from the draft report, which was anticipated to be tabled in the House. Citing Lok Sabha rules, Banerjee argued that only the Speaker has the authority to suspend members, making the actions of the chairman “illegal.”

Banerjee expressed his reluctance to approach the court, stating, “I have trust in the Speaker and hope he will resolve the issue as the custodian of the House.” He emphasized the need for clarity, saying, “If I do not question the legality of the Order of Suspension, future generations shall blame me.”

Request for Inclusion of Dissent Notes

Banerjee’s second letter raised alarms over the deletion of dissent notes from the circulated draft. He pointed out that such deletions can only be authorized by the Speaker, urging Birla to reinstate the dissent notes to ensure a comprehensive report.
