Supreme Court Offers Relief to Isha Foundation Amid Environmental Concerns
In a significant ruling on Friday, the Supreme Court of India has provided much-needed relief to the Isha Foundation, led by Sadhguru, by quashing a show cause notice issued by the Tamil Nadu government. The notice alleged that the foundation had carried out constructions for its yoga and meditation centre in Coimbatore without the requisite environmental clearance between 2006 and 2014.
Judicial Protection Upheld
The apex court upheld a 2022 decision from the Madras High Court, which had previously quashed the notice against the Isha Foundation. Justices Surya Kant and N K Singh stated, “As we approve the decision of HC, no coercive action will be taken by TNPCB against Isha Foundation for constructions carried out in the past.” This ruling comes as a relief to the foundation, allowing it to continue its operations without the looming threat of legal action.
Environmental Concerns Addressed
While the court’s decision has been welcomed by the Isha Foundation, it has also raised concerns among state officials. Advocate General P S Raman emphasized that the yoga centre is located near a wildlife sanctuary, cautioning that such judicial protection should not serve as a “gate-pass” for future constructions without necessary environmental clearances. The bench agreed, ensuring that this ruling would not set a precedent for others to bypass environmental regulations.
Future Compliance Assured
In response to the court’s concerns, the Isha Foundation, represented by advocate Mukul Rohatgi, assured the court that all necessary prior clearances for any future construction would be obtained from the relevant authorities.
