Rajasthan High Court Stops Demolition of Properties Linked to Rape-Blackmail Accused

JAIPUR/AJMER: In a significant ruling, the Rajasthan High Court has prohibited the Bijaynagar Municipality in Beawar from demolishing properties associated with suspects in a gangrape and blackmail case involving five schoolgirls. This decision comes amid allegations that the state government is “hell-bent” on demolitions that violate Supreme Court guidelines.

Judicial Intervention

Justice Mahendar Goyal’s order to maintain the status quo was issued in response to a petition from five individuals who received demolition notices on February 20. These notices were based on alleged violations under sections 194 and 245 of the Rajasthan Municipality Act.

Legal Representation and Allegations

Syed Saadat Ali, the counsel for the petitioners, accused the administration of ignoring responses to the demolition notices. He highlighted the Supreme Court’s guidelines, which mandate thorough inspections before any demolition and require consent from two elected representatives. These measures are designed to ensure that only unauthorized and non-compoundable constructions are targeted.

Next Steps

The court has directed Ali to provide a copy of the writ petition to additional advocate general GS Gill, with the next hearing scheduled for March 11. This development comes after eleven suspects were arrested and three juveniles detained since FIRs were registered on February 16, based on complaints by the schoolgirls’ families.
