Jammu & Kashmir: The New BNSS Provisions and Their Impact on Terror Trials

In a significant move to enhance the legal framework in Jammu & Kashmir (J&K), Union Home Minister Amit Shah has emphasized the urgent need to implement the Bharatiya Nagarik Suraksha Sanhita (BNSS) provisions. These include allowing ‘trial in absentia’ for proclaimed offenders who evade trial, particularly in terrorism cases.

Facilitating Trials Against Terror Masterminds

During a recent meeting to review the implementation of new criminal laws in J&K, Shah highlighted that the ‘trial in absentia’ provision aims to facilitate proceedings against terror masterminds based in Pakistan and Pakistan-occupied Kashmir. With Section 355 and 356 of the BNSS, Indian courts can now try these accused individuals in their absence, ensuring that justice is served even when the culprits are beyond reach.

Progress in Implementation

Reports from the J&K LG’s office indicate that the infrastructure necessary for the full rollout of the new laws is nearing completion. Training for the J&K Police in the new criminal justice system is approximately 72% complete, with Shah urging swift finalization.

Awareness and Citizen Rights

Chief Minister Omar Abdullah has underscored the importance of raising awareness about these laws within educational institutions and social circles. Shah has also called for the J&K Police to prioritize citizen rights, emphasizing the need to expedite chargesheets while ensuring scrutiny to prevent misuse of anti-terror provisions.
