Uttarakhand High Court Questions Proposed Changes to the Uniform Civil Code
DEHRADUN: In a significant legal development, the Uttarakhand High Court has asked the state whether fresh suggestions for amendments to the Uniform Civil Code (UCC) should be invited. This inquiry emerged during the hearing of two petitions challenging the constitutional validity of the UCC Act and Rules.
Legal Perspectives on UCC
A division bench comprising Justices Manoj Tiwari and Ashish Naithani directed the state to submit a counter by April 1. Advocate Vrinda Grover, representing the petitioners—including activists and a live-in couple—argued that the UCC establishes an “excessive surveillance regime,” infringing upon personal choices and the right to privacy.
Concerns Regarding Implementation
Grover highlighted that the law, purportedly a safeguard for women, risks leading to harassment and social coercion. She also challenged the provision mandating Aadhaar linkage for registration, referencing the Supreme Court’s Puttaswamy ruling on privacy. Chief standing counsel C S Rawat indicated that the court suggested the state legislature consider necessary modifications.
