Supreme Court Upholds NEET Eligibility for Medical Courses Abroad
NEW DELHI: In a significant ruling, the Supreme Court of India has declined to interfere with a 2018 regulation set forth by the Medical Council of India (MCI). This regulation mandates that students must qualify for the National Eligibility cum Entrance Test (NEET) to gain eligibility for pursuing undergraduate medical courses in foreign institutions.
Fairness and Transparency in Medical Admissions
A bench comprising Justices B R Gavai and K Vinod Chandran emphasized that the introduction of the NEET qualification criterion ensures a fair and transparent process for granting eligibility certificates. The Court clarified that the regulation aligns with the law and does not infringe upon any constitutional rights.
No Exemptions for NEET Qualification
The bench stated, “We find absolutely no reason to interfere with the regulations. Candidates seeking admission to foreign institutions for primary medical qualifications cannot request exemptions from the regulations.” Importantly, the ruling does not restrict their right to practice medicine outside India.
Regulations Are Constitutional
The Court further stated that the NEET eligibility requirements are not arbitrary or unreasonable. Consequently, all petitions challenging the regulation were dismissed, reinforcing the necessity for medical aspirants to clear NEET.
