President Grants Sanction for Prosecution of AAP Leader Satyendar Jain in Money Laundering Case

NEW DELHI: In a significant development, President Droupadi Murmu has granted sanction to the Enforcement Directorate (ED) to prosecute AAP leader and former Delhi minister Satyendar Jain in a money laundering case, as reported by news agency PTI.

The ED arrested Jain in May 2022 over alleged hawala transactions. At the time of his detention, Jain was overseeing critical portfolios, including health and power. The Ministry of Home Affairs, based on the ED’s investigation and sufficient evidence, sought presidential sanction for the prosecution under Section 218 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).

Legal Framework for Prosecution

Section 218 of the BNSS outlines the legal procedures for initiating proceedings against public servants and judges for alleged misconduct during their tenure. Following the President’s approval, the ED plans to submit a supplementary charge sheet to inform the court about the sanction for prosecution.

Details of the Investigation

Currently released on bail, Jain faces serious charges filed by the ED. The agency’s investigation revealed that around Rs 27.7 crore was funneled through five shell companies—Prayas Infosolutions Pvt Ltd, Indo Metal Impex Pvt Ltd, JJ Ideal Estate Pvt Ltd, Akinchan Developers Pvt Ltd, and Mangalyatan Projects Pvt Ltd—to purchase 123 acres from 14 individuals.

Statements from Jain’s chartered accountant and several Kolkata-based hawala operators indicated that these shell companies were controlled by Jain through his wife and associates. They corroborated claims that cash was paid to hawala dealers, and unsecured loans were recorded in these companies.

Jain’s Political Tenure

Satyendar Jain served as a minister in the AAP government in Delhi from December 28, 2013, to February 14, 2014, and again from February 2015 until his arrest in 2022.
